These Customer Terms of Service (“Customer Terms”) govern access to and use of the Carmauto Platform (the “Platform”) by individuals or entities seeking automotive services or purchasing products (“Customers,” “you,” or “your”).
Carmauto Inc. (“Carmauto,” “CarmAuto,” “we,” “our,” or “us”) operates a digital technology platform that connects Customers with automotive service providers (“Mechanics”) for automotive services (“Services”) and facilitates the purchase of automotive products, parts, and accessories (“Products”) from automotive suppliers (“Vendors”).
These Customer Terms supplement and are incorporated by reference into the Terms and Conditions of Use (“Terms”). In the event of conflict, the Terms control unless expressly stated otherwise.
By accessing, browsing, purchasing, or using any portion of the Carmauto Platform, including scheduling Services, purchasing Products, or submitting reviews, you acknowledge that you have read, understood, and agreed to be bound by these Customer Terms and all incorporated policies in the Terms.
Independent Mechanics. All Mechanics listed on the Platform operate as independent businesses. They are not employees, agents, or representatives of Carmauto.
Neutral Technology Provider. Carmauto provides the Platform, communication tools, and payment facilitation for Services and Products but does not itself perform mechanical work or guarantee outcomes.
Third-Party and Marketplace Products. Products may be sold by Carmauto, Mechanics, or other third-party vendors. Unless explicitly indicated as “Sold by Carmauto,” the transaction occurs directly between the Customer and the vendor of record.
No Agency Relationship. Nothing in these Customer Terms creates any partnership, employment, or joint-venture relationship between Carmauto and any Mechanic or Product Vendor.
Assumption of Risk. By using the Platform, the Customer acknowledges that all Services and Product transactions carry inherent risks and that Carmauto will not be responsible for the acts, omissions, warranties, or representations of Mechanics, Vendors, or other Users.
No Warranty of Workmanship or Outcomes. Carmauto does not evaluate, supervise, direct, or control any Services. Mechanics alone are responsible for workmanship, diagnostics, repair decisions, parts selection, safety practices, and results. Carmauto makes no warranty of repair quality, safety, durability, or suitability.
Customers must be at least eighteen (18) years of age, have legal capacity to enter binding contracts, and provide accurate and current registration information. Carmauto may suspend or terminate any Customer account for fraud, misrepresentation, or violation of law or policy.
Accuracy of Information. Customers must provide accurate, complete, and up-to-date vehicle, contact, and payment information. Customers will bear full responsibility for errors, losses, or delays resulting from inaccurate or incomplete information.
Payment Obligations. All payments for Services or Products must be made through Carmauto’s authorized Third-Party Payment Provider through the Platform. Payment is due upon Service completion or Product checkout unless otherwise specified. Customers authorize Carmauto and its payment partners to debit their designated payment method for all agreed amounts. Customers must not solicit or complete payments outside the Platform. Any such conduct constitutes a material breach and voids all Carmauto protections, including refunds and dispute coverage.
Lawful and Respectful Conduct. Customers must act respectfully and lawfully toward Mechanics, Vendors, other Users, and Carmauto personnel. Harassment, defamation, discrimination, intimidation, or abusive behavior is prohibited. Customers who choose to have a mechanic travel to a specific location that is not the Mechanic’s shop (“Mobile Mechanic”) must ensure that any property on which Services are performed is safe, lawful, and accessible.
Safe Work Environment Requirement. For Mobile Mechanics, Customers must provide a workspace that is safe, lawful, and accessible, including adequate lighting, flat surfaces, and compliance with any local regulations governing mobile automotive repair. Mechanics may refuse Service if conditions are unsafe or unlawful without penalty.
Cooperation in Disputes. Customers should first attempt to resolve disputes directly with the Mechanic or Vendor before escalating. Formal disputes must include all relevant documentation (e.g., photographs, receipts, service logs, or communications) and be submitted within the timeframe set forth in the Dispute Resolution & Refund Policy. Carmauto may investigate and issue determinations including credits, reversals, or partial refunds. Such determinations are final for Platform purposes.
A posted Review does not mean Carmauto endorses, verified, or approved of the review’s accuracy. Carmauto may remove, edit, or flag reviews that violate this Section or the Review Moderation & Verification Rules but is not obligated to do so. Carmauto acts as a neutral service provider under 47 U.S.C. § 230 and will not be treated as the publisher or speaker of any User-generated content. Carmauto will not be liable for reputational or economic damages resulting from User reviews, whether verified or unverified, or from delays or failures in removing them.
Product Use and Compliance. Customers are responsible for verifying that any Product purchased is appropriate for their vehicle and complies with applicable safety standards. Carmauto will not be liable for improper installation, misuse, or unauthorized modification of Products. Unless expressly stated otherwise, Products are sold “as is.” Manufacturer warranties, if any, are provided directly by the manufacturer or Vendor.
Third-Party Product Liability. Products sold by Mechanics or Vendors are the sole responsibility of the seller. Carmauto is not responsible for product defects, recalls, installation issues, compatibility problems, or damages caused by third-party items.
Vehicle Condition Representations. To the best of your knowledge, Customers represent that the vehicle is safe to inspect, diagnose, test, and operate and is not in violation of local laws (e.g., stolen vehicles, illegal modifications, or unsafe conditions).
Authorization for Diagnostics and Test Drives. By requesting Services, Customers authorize Mechanics to perform reasonable diagnostic procedures and test drives unless expressly prohibited. Customers are responsible for disclosing known hazards (e.g., failing brakes, leaking fuel).
Responsibility for Missed or Inaccessible Appointments. Customers may be charged, in part or whole, for missed appointments, failure to provide access to the vehicle, failure to ensure safe parking/loading conditions, and any delay, obstruction, or inability to begin or complete the service that results from the Customer’s actions, inactions, or failure to meet the requirements set forth in these Terms.
Approval for Additional Work. Mechanics must obtain Customer approval for work not included in the original estimate and update this accordingly on the Platform. Customers are responsible for reviewing and responding to updated quotes.
Taxes and Fees. Customers are responsible for any applicable taxes, duties, or government charges. Carmauto assumes no responsibility for Customer tax compliance.

This list is non-exhaustive. Customers are prohibited from engaging in any other conduct that causes harm, risk, disruption, or unfairness to Carmauto, the Platform, Mechanics, Vendors, or other Users, or that undermines the safe and honest operation of the Platform.
Violation of this Section constitutes a material breach. Carmauto may suspend or terminate accounts, withhold funds, cancel orders, and pursue damages or injunctive relief.
Sales and Delivery. Product details and pricing are provided by Carmauto or third-party sellers. Carmauto does not warrant that listings are error-free or up to date. Title and risk of loss transfer upon delivery to the carrier unless otherwise stated.
Returns and Exchanges. Products marked “Final Sale” or “Non-Returnable” are excluded from return eligibility. Return timelines and procedures follow the Dispute Resolution & Refund Policy. Products must be returned in original condition unless defective upon receipt. Product returns may also be subject to the individual Vendor’s return, warranty, or exchange policies where the Vendor is the seller of record. Carmauto may deny refunds for damage caused by misuse, improper installation, or alteration.
Product Warranties. Unless explicitly stated, Carmauto provides no express or implied warranty. Manufacturer warranties, if applicable, are administered directly by the manufacturer or Vendor.
Installation Disclaimer. Even if a Product is purchased through the Platform, any installation is performed solely by independent Mechanics. Carmauto does not warranty installation or labor performed by Mechanics.
The Platform, Services, and Products are provided “as is” and “as available.” Carmauto disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, Carmauto will not be liable for indirect, incidental, consequential, or punitive damages, including loss of income, goodwill, or business opportunity.
Aggregate Liability Cap. Carmauto’s total cumulative liability to any Customer will not exceed the greater of:
Customer Indemnification. Customers agree to indemnify and hold harmless Carmauto, its officers, directors, employees, and affiliates from all claims, losses, and expenses (including attorneys’ fees) arising from:

No Liability for Mechanic Insurance Coverage. Carmauto does not verify or guarantee that Mechanics maintain insurance coverage. Any insurance benefit or claim is strictly between the Customer and the Mechanic.
Vehicle Damage or Loss During Service. Any damage, theft, loss, contamination, environmental spill, or injury occurring during or connected to Services is the sole responsibility of the Mechanic and/or Customer. Carmauto will not be liable for such events.
Carmauto may suspend or terminate Customer accounts for misconduct, fraud, or off-platform solicitation. Termination does not waive payment obligations for completed Services or delivered Products. Carmauto may retain transaction data for legal and compliance purposes.
By using the Platform, Customers consent to receive electronic notices and communications. Data collection and processing are governed by Carmauto’s Privacy Policy. Carmauto may record communications for training, safety, or dispute-resolution purposes.
On-Platform Communication Requirement. Customers must communicate with Mechanics through the Platform where reasonably possible. Off-platform communications may limit Carmauto’s ability to assist with disputes or enforce protections.
These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law. Any permitted court proceedings must be brought exclusively in Delaware state or federal courts.
These Terms, together with the Terms and incorporated policies, constitute the entire agreement between the parties. Invalid provisions shall be severed, leaving the remainder in full force. Carmauto may assign its rights or obligations at any time; Customers may not assign without consent.
Survival. Any obligations that by their nature should survive termination will remain in full force, including but not limited to payment obligations, indemnification duties, review and content licenses, dispute-resolution procedures, limitation-of-liability provisions, and Carmauto’s rights to retain and use transaction data for compliance, safety, fraud prevention, and recordkeeping.

Continued use of the Platform constitutes your electronic signature and acceptance of this legally binding agreement.
